Builder Terms of Service
1. Agreement
These Builder Terms of Service ("Terms") form a binding agreement between [●] (ABN [●]) ("Homeygo", "we", "us") and the building business that registers on the Homeygo platform ("Builder", "you"). By registering, you agree to these Terms on behalf of your business, and you confirm you are authorised to bind it.
2. Registration, licensing and verification
- You must provide accurate business details, including your legal/business name, ABN (and ACN if applicable), builder licence number, and contact details.
- You warrant that you hold, and will maintain for as long as you use the Platform, all licences, registrations, insurances (including public liability and any required home warranty/indemnity insurance) and approvals required by law to carry out residential building work in the areas you service.
- You authorise us to verify your ABN and other details against public registers (including the Australian Business Register) and to make reasonable enquiries about your business.
- Registration does not guarantee approval. We may approve, decline, suspend or revoke your access at our discretion, including where verification is incomplete or details appear inaccurate. "Verified Homeygo Builder" status reflects a limited check only and may be withdrawn at any time.
3. Your profile and content
- You are responsible for all content you upload (including your business description, logo, photos, ratings information and service areas). You warrant that you own it or have the right to use it, and that it is accurate and not misleading.
- You must not upload content that is false, deceptive, unlawful, infringing, or that misrepresents your qualifications, experience, licensing or past work. This includes photographs of homes you did not build and reviews or ratings that are not genuine.
- Providing false or misleading profile information (including in relation to reviews, ratings or completed projects) is a serious breach and may result in immediate removal and blacklisting under section 7, and may contravene the Australian Consumer Law.
- You grant Homeygo a non-exclusive licence to display your content on the Platform and in related marketing for the purpose of promoting your business to customers.
4. Leads and customer information
- When a customer requests a quote from you through the Platform, we pass you that customer’s details and project information (a "Lead").
- You must use Lead information only to respond to and service that customer’s genuine enquiry. You must handle it in accordance with the Privacy Act 1988 (Cth) and must not sell it, misuse it, or use it for unrelated marketing.
- We do not guarantee any number of Leads, any Lead quality, or that any Lead will result in work.
5. Your conduct and obligations to customers
- You will deal with customers honestly, professionally, lawfully and in accordance with the Australian Consumer Law and all applicable building laws and standards.
- Any contract for building work is solely between you and the customer. Homeygo is not a party to it and has no responsibility for your work, pricing, timelines, conduct or disputes.
- You are solely responsible for your quotes, contracts, workmanship, warranties, and compliance with all building, safety, licensing, tax and consumer laws.
- You will not do anything that damages the reputation of Homeygo or its customers.
6. Commission and fees
This section describes how Homeygo is paid. It is the commercial heart of this agreement.
- You agree to pay Homeygo a commission of [●]% (or [●]) on the contract value of any building work where the customer was introduced to you, or submitted a quote request to you, through the Homeygo Platform (a "Platform-Originated Lead").
- A customer is a Platform-Originated Lead if they submitted a quote request or connection request to you through Homeygo, regardless of whether you and that customer had any prior contact. The trigger for commission is the request coming through the Platform — not how you first met the customer.
- Commission is payable when you enter into a building contract (or receive payment) with a Platform-Originated Lead, whether that contract is signed on the Platform, off the Platform, during or after the period you use Homeygo, or within [●] months after that Lead was provided. Commission survives termination for Leads provided before termination.
- You must notify Homeygo within [●] business days of entering into a contract with a Platform-Originated Lead, and provide the contract value for commission calculation. Homeygo may require reasonable evidence and, on reasonable notice, may audit your records to confirm commission owed.
- Invoices are payable within [●] days. Overdue amounts may accrue interest at [●]% and you are liable for reasonable costs of recovery.
7. Anti-circumvention and blacklisting
This section protects Homeygo’s commission from being avoided.
- You must not attempt to avoid or reduce commission owed on a Platform-Originated Lead by any means, including by diverting the customer off-platform, encouraging the customer to withdraw or re-submit their enquiry outside Homeygo, structuring or splitting contracts, using a related entity, or agreeing with the customer to conceal that the introduction came through Homeygo.
- If Homeygo reasonably determines that you have engaged in circumvention, provided false information, or otherwise seriously breached these Terms, we may (in addition to recovering commission owed and any other remedy) immediately suspend or permanently remove and blacklist your business from the Platform, and decline future registrations by you or your related entities.
- You acknowledge that blacklisting for circumvention or dishonesty is a reasonable protection of Homeygo’s legitimate business interests.
8. Suspension, removal and termination
- Either party may end this agreement on notice. You can stop using the Platform at any time; Homeygo may remove your access at any time, with or without cause.
- Sections that by their nature should survive termination — including commission owed on Platform-Originated Leads (section 6), anti-circumvention (section 7), confidentiality, and liability — continue after termination.
9. Confidentiality
Each party will keep the other’s non-public business information confidential and use it only for the purposes of this agreement. Customer personal information must be handled strictly in accordance with the Privacy Act and section 4.
10. Disclaimers and limitation of liability
Nothing in these Terms excludes any right or remedy that cannot lawfully be excluded, including under the Australian Consumer Law where it applies to you.
- The Platform is provided “as is”. Homeygo does not guarantee Lead volume, Lead quality, uptime, or any commercial outcome.
- To the maximum extent permitted by law, Homeygo is not liable to you for any loss of profit, loss of opportunity, or indirect or consequential loss arising from your use of the Platform or any Lead.
- Where liability cannot be excluded but can be limited, Homeygo’s total liability to you is limited, to the extent permitted by law, to the total fees you paid to Homeygo in the [●] months before the claim.
- You indemnify Homeygo against claims, losses and costs arising from your building work, your contracts with customers, your content, or your breach of these Terms, except to the extent caused by Homeygo’s own fault.
11. Relationship of the parties
Nothing in these Terms creates a partnership, joint venture, employment or agency relationship between you and Homeygo. You are an independent business. Homeygo introduces customers; it does not build, supervise building work, or act as your agent.
12. Changes to these Terms
We may update these Terms on reasonable notice. If a change materially affects your commercial obligations (such as commission), we will notify you, and your continued use after the change takes effect constitutes acceptance.
13. Governing law
These Terms are governed by the laws of [●] (state/territory), Australia, and the parties submit to the non-exclusive jurisdiction of the courts of that place.
